Overview
Welcome to The Candle Plug.
The terms “The Candle Plug,” “we,” “us,” and “our” refer to The Candle Plug. We operate this website and online store, including the information, content, features, tools, products, and services made available through it collectively, the “Services.”
Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you.
These Terms of Service, together with the policies referenced within them, explain the rights and responsibilities that apply when you visit our website, purchase a product, create an account, submit content, or otherwise use our Services.
By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy. When you purchase from us, you also agree to our Shipping Policy, Returns and Refunds Policy, Cancellation Policy, and Candle Care and Safety Policy.
Do not use the Services if you do not agree to these terms.
Section 1 – Eligibility and Account Information
By using the Services, you represent that you are at least the age of majority in your state, province, or place of residence. Alternatively, you represent that you have the permission of a parent or legal guardian to use the Services.
You may be asked to provide information such as your name, email address, billing information, payment details, and shipping address.
You agree that all information you provide will be accurate, current, and complete. You also represent that you are authorized to provide and use that information.
You are responsible for protecting your account credentials and for all activity conducted through your account. You may not sell, transfer, assign, or provide your account to another person without our permission.
Section 2 – Our Products
The Candle Plug offers curated candles and related products.
Certain products, including products in our Core Collection, may be designed and curated by The Candle Plug and then produced or fulfilled by trusted production partners. Small-Batch Originals, when available, may be developed, tested, and hand-poured directly by The Candle Plug.
The production method, specifications, materials, fragrance notes, expected burn time, and other relevant information will be described on the applicable product page.
We make reasonable efforts to present product photographs, colors, labels, dimensions, fragrances, and other details accurately. However, actual appearance may vary because of:
- Screen and device settings
- Lighting and photography
- Manufacturing or material variations
- Label placement
- Wax appearance
- The natural characteristics of hand-poured products
Fragrance is subjective. The perceived strength and character of a scent may vary based on personal sensitivity, room size, airflow, temperature, and other environmental conditions.
We do not guarantee that a product’s appearance, scent, strength, or other qualities will exactly match your personal expectations.
Product descriptions, pricing, availability, and specifications may be updated without notice. We may discontinue products or limit the quantities available to a person, household, geographic area, or jurisdiction.
Section 3 – Candle Use and Safety
Candles contain an open flame and must be used responsibly.
By purchasing or using our candles, you agree to:
- Review and follow the warning label provided with the candle
- Follow our published Candle Care and Safety instructions
- Keep burning candles within sight
- Keep candles away from children, pets, drafts, and flammable materials
- Place candles on stable, heat-resistant surfaces
- Avoid moving a candle while it is burning or while the wax is hot
- Discontinue use if the vessel becomes cracked, chipped, or otherwise damaged
- Stop burning the candle when approximately ½ inch of wax remains
Never leave a burning candle unattended.
The Candle Plug is not responsible for loss or damage caused by misuse, failure to follow safety instructions, modification of the product, use of a damaged candle, or use for a purpose other than its intended purpose.
Nothing in this section limits any responsibility that cannot legally be excluded.
Section 4 – Orders
Submitting an order constitutes an offer to purchase products from The Candle Plug.
We reserve the right to accept, reject, limit, or cancel an order. An automated order confirmation does not necessarily mean that an order has entered production or been accepted for fulfillment.
We may reject or cancel an order because of:
- Product availability
- Pricing or listing errors
- Suspected fraud or unauthorized activity
- Payment problems
- Shipping restrictions
- Production limitations
- Violation of these Terms
- Other circumstances that prevent fulfillment
When we cancel an order after payment has been collected, we will issue an appropriate refund.
Please review product selections, quantities, personalization, billing details, and shipping information before submitting an order. Made-to-order products may enter production shortly after purchase. Therefore, changes or cancellations may not be possible after production begins.
Purchases are subject to our Returns and Refunds Policy and Cancellation Policy.
Unless we expressly agree otherwise, products purchased through the Services are intended for personal or household use and not for unauthorized resale or export.
Section 5 – Prices, Payments, and Billing
Prices, promotions, discounts, and product availability may change without notice.
The price charged will be the price displayed when the order is submitted, subject to correction of errors. Unless expressly stated otherwise, displayed product prices do not include shipping, handling, taxes, customs charges, import duties, or similar fees.
Available charges will be displayed during checkout when they can be calculated.
You agree to provide accurate and complete purchase and payment information. You also agree to update your information when necessary so that we can process your order and contact you.
By submitting payment information, you represent that:
- You are authorized to use the selected payment method
- The information provided is accurate
- The payment provider is authorized to process the transaction
- You will pay the total amount shown during checkout
We may use third-party payment processors. Your use of their services may also be governed by their terms and privacy practices.
Section 6 – Shipping and Delivery
Orders are subject to our Shipping Policy.
Certain products are made to order. As a result, production time occurs before carrier transit begins.
Processing, production, shipping, and delivery dates are estimates unless expressly stated otherwise. Delays may occur because of production volume, inventory availability, holidays, weather, customs processing, carrier disruptions, incorrect addresses, or circumstances outside our reasonable control.
Products within one order may be produced at different locations and arrive in separate shipments.
You are responsible for providing a complete and accurate delivery address. Contact us promptly when you discover an error. However, address changes may not be possible once an order enters production or shipping preparation.
Risk of loss and responsibility for delivery will be determined according to applicable law and the circumstances of the shipment.
Section 7 – Returns, Refunds, and Cancellations
Returns, replacements, refunds, and exchanges are governed by our Returns and Refunds Policy.
Because certain products are made to order, we may not accept returns or exchanges based solely on:
- A change of mind
- Personal fragrance preference
- An incorrect item or quantity selected by the customer
- A customer-provided address error
- A product that has been opened, burned, used, or altered
Damaged, defective, or incorrectly produced products should be reported according to the process and timeframe stated in our Returns and Refunds Policy.
Cancellation requests are governed by our Cancellation Policy. We will make a reasonable effort to assist, but we cannot guarantee cancellation after an order enters production.
These restrictions do not affect rights that cannot be waived under applicable consumer-protection law.
Section 8 – Intellectual Property
The Services and their content are owned by or licensed to The Candle Plug and are protected by applicable intellectual-property laws.
Protected content may include:
- The Candle Plug name and logo
- Product and collection names
- Label and packaging designs
- Written content
- Product descriptions
- Photographs
- Graphics
- Videos
- Audio
- Website layouts
- Brand slogans
- Other original creative materials
You may access the Services for personal, noncommercial use.
Without our prior written permission, you may not reproduce, distribute, modify, republish, sell, license, publicly display, create derivative works from, or commercially exploit our content.
“The Candle Plug,” related logos, product names, designs, and slogans may be trademarks or other protected brand assets. You may not use them in a way that creates confusion, suggests endorsement, or misrepresents an association with us.
Shopify and other third-party names, logos, and trademarks belong to their respective owners.
Section 9 – Optional Third-Party Tools
We may provide access to tools, features, applications, or services operated by third parties.
We do not necessarily control or monitor these third-party tools. Unless expressly stated otherwise, access is provided on an “as is” and “as available” basis.
Your use of third-party tools is at your own discretion and may be governed by separate terms and privacy policies. You should review those policies before using the tools.
We may introduce new features, tools, or resources in the future. Unless otherwise stated, they will form part of the Services and remain subject to these Terms.
Section 10 – Third-Party Links
The Services may contain links to websites, content, products, or services operated by third parties.
We are not responsible for reviewing or guaranteeing the accuracy, security, availability, practices, or content of third-party websites.
Accessing a third-party website is at your own discretion. Before making a transaction or submitting information, review the third party’s policies and terms.
Questions or disputes concerning a third party’s products or services should generally be directed to that third party.
Section 11 – Relationship With Shopify
The Candle Plug is powered by Shopify, which provides the ecommerce platform used to operate the Services.
However, purchases made through our store are transactions directly between you and The Candle Plug. Shopify is not the seller of our candles and is not responsible for the products offered by The Candle Plug.
To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchase or use of products sold by The Candle Plug.
Section 12 – Privacy
Personal information collected through the Services is handled according to our Privacy Policy.
Because our store is hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services. Information may also be shared with payment processors, production partners, shipping carriers, analytics providers, marketing providers, and other service providers when necessary to operate the store and fulfill orders.
Please review our Privacy Policy for more information about how personal information is collected, used, disclosed, and protected.
Section 13 – Reviews, Feedback, and Submissions
When you submit a review, photograph, comment, suggestion, testimonial, idea, or other content, collectively called “Feedback,” you represent that you have the right to submit it.
Unless prohibited by law or separately agreed in writing, you grant The Candle Plug a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, distribute, and promote the Feedback in connection with our business and Services.
You agree that your Feedback will not:
- Infringe another person’s intellectual-property, privacy, publicity, or other rights
- Contain false, misleading, defamatory, unlawful, abusive, or obscene material
- Include malware or harmful code
- Misrepresent your identity
- Conceal compensation or incentives that should legally be disclosed
We may monitor, edit, decline, or remove Feedback, but we are not required to do so.
You remain responsible for the accuracy and legality of anything you submit.
Section 14 – Errors and Inaccuracies
Occasionally, the Services may contain typographical errors, inaccurate information, or omissions involving:
- Product descriptions
- Fragrance notes
- Pricing
- Promotions
- Availability
- Shipping charges
- Production or transit estimates
- Product images or specifications
We may correct or update information without prior notice.
When an error materially affects an order, we may contact you, revise the order with your consent, or cancel the affected item and issue an appropriate refund.
Section 15 – Prohibited Uses
You may use the Services only for lawful purposes.
You may not use the Services to:
- Violate any applicable law or regulation
- Infringe our rights or the rights of another person
- Submit false, fraudulent, or misleading information
- Harass, threaten, abuse, defame, or discriminate against another person
- Transmit malware, viruses, or harmful code
- Collect personal information without authorization
- Send spam, phishing messages, or unauthorized solicitations
- Impersonate another person or organization
- Circumvent security or access controls
- Scrape, copy, extract, resell, or exploit the Services without permission
- Interfere with the operation or security of the website
- Use the Services in a manner that could expose The Candle Plug, Shopify, our partners, or other users to harm or liability
We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated.
Section 16 – Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate access to the Services when:
- You violate these Terms
- We suspect fraud, abuse, or unlawful conduct
- Your use creates a security or operational risk
- We discontinue the Services
- Termination is otherwise permitted by law
Termination does not eliminate payment obligations or other responsibilities that arose before termination.
Provisions that should reasonably survive termination will remain effective. These may include intellectual property, feedback licenses, disclaimers, liability limitations, indemnification, governing law, and payment obligations.
Section 17 – Disclaimer of Warranties
To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis, except for warranties expressly provided by The Candle Plug or required by law.
We do not guarantee that:
- The Services will always be uninterrupted, secure, or error-free
- All website information will always be complete or current
- A product will meet every personal fragrance or aesthetic preference
- Colors or appearance will display identically across devices
- Delivery will occur on an exact estimated date
Some jurisdictions do not allow certain warranty exclusions. Therefore, some of these limitations may not apply to you.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Section 18 – Limitation of Liability
To the fullest extent permitted by law, The Candle Plug and our owners, employees, affiliates, agents, contractors, licensors, production partners, service providers, and suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:
- Access to or use of the Services
- Inability to access the Services
- Products purchased through the Services
- Errors or omissions in content
- Unauthorized access to information
- Shipping or production delays
- Improper or unsafe use of a product
This may include loss of profits, revenue, savings, data, goodwill, or replacement costs.
Where liability cannot be completely excluded, our total liability will be limited to the amount you paid for the product or transaction giving rise to the claim, unless applicable law requires otherwise.
Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or another responsibility that cannot legally be limited.
Section 19 – Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless The Candle Plug, Shopify, and our respective affiliates, employees, agents, contractors, licensors, production partners, service providers, and suppliers from third-party claims, losses, liabilities, costs, or reasonable legal fees arising from:
- Your material breach of these Terms
- Your unlawful use of the Services
- Your violation of another person’s rights
- Content or Feedback you submit
- Your intentional misuse of a product
We will provide reasonable notice of an indemnifiable claim when practical. You agree to cooperate in its defense.
Section 20 – Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.
The remaining provisions will continue in effect.
Section 21 – Waiver and Entire Agreement
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with the policies and rules referenced within them, constitute the entire agreement between you and The Candle Plug concerning the Services.
They replace prior communications or agreements concerning the same subject matter.
Section 22 – Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written permission.
We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale, restructuring, change in business ownership, or transfer of the Services, subject to applicable law.
Section 23 – Governing Law
These Terms and any dispute relating to the Services will be governed by the laws of the State of [INSERT STATE], without regard to conflict-of-law rules.
Any legal proceeding will take place in the appropriate state or federal courts located in [INSERT COUNTY AND STATE], unless applicable consumer law provides otherwise.
Section 24 – Changes to These Terms
You may review the current version of these Terms on this page.
We may update these Terms to reflect changes in:
- Our Services
- Our products or fulfillment model
- Legal or regulatory requirements
- Our business practices
- Shopify or other service-provider requirements
The updated version will be posted with a revised “Last updated” date.
When required by law, we will provide additional notice of material changes. Continued use of the Services after revised Terms become effective constitutes acceptance of those revisions.
